Overview

A working guide for taking a Vietnamese data center site from raw land to an energized, leased facility — what to do, in what order, and what it costs when the order is wrong.

The organising idea behind the series is simple: data center development used to be a real estate business with an electrical problem attached, and is now an electricity business with a real estate problem attached. Every sequencing recommendation follows from that inversion.

Vietnam is the market where that inversion has been legislated in real time, and recently enough that most desk research is describing a regime that no longer exists. The Law on Electricity was replaced outright — Law 61/2024/QH15, passed on 30 November 2024 and in force from 1 February 2025 — and the decrees that make it work arrived together in the first days of March 2025: Decree 56/2025/NĐ-CP, Decree 57/2025/NĐ-CP on direct power purchase, and Decrees 58, 61 and 62 of the same year. Anything written about Vietnamese grid connection before 2025 should be treated as void until checked.

The land and construction layer moved on a different clock, and the gap between the two is where schedules die. The 2024 Land Law took effect on 1 August 2024, brought forward by an amending law passed that June. The new Construction Law commences in July 2026 — but its permit-exemption list and its commencement-notice duty came into force on 1 January 2026, six months ahead of the rest. A team that reads only the headline commencement date will get the sequence wrong in both directions.

Then the layer most publications leave out. A data centre in Vietnam does not sit outside the telecommunications and data regime; it sits inside it. The Law on Telecommunications deferred its data centre and cloud provisions to 1 January 2025. The Law on Data and the Law on Digital Technology Industry followed, with the latter's data centre investment incentives commencing early. The Law on Personal Data Protection applies from 1 January 2026, and a new Law on Cybersecurity from 1 July 2026, its implementing decrees signed in August 2026. This edition will treat that stack as part of the development sequence, because in this market it decides who may operate the building and on what terms.

Research and sources

Every instrument named will be cited to its own number, the date it was signed, the date it takes effect, and the government source it was read at. Where an instrument has been amended, superseded or consolidated, that is recorded against the instrument rather than left for the reader to discover. Vietnamese law in this area is moving faster than any other part of the country's infrastructure regulation — the electricity regime was replaced outright with effect from 2025, and the data and cybersecurity regime turns over across 2025 and 2026 — so material figures carry an "as of" date, practitioner assumptions are identified as such rather than presented as measured fact, and anything intended to carry a decision should be re-read against its own instrument on the day it is relied on.
